General information regarding the service
Legal services are provided; these include both out-of-court and court proceedings. They generally consist of representing the client’s interests. Mandates are not concluded within the framework of a sales or service system organised for distance selling. Where General Terms and Conditions apply in individual cases, they will be provided to the client prior to the issuance of a written mandate. The legal fee cannot be specified in advance in the present case. It is calculated either in accordance with the Lawyers’ Fees Act (RVG) and is then determined by the value of the matter and the scope of the work. Alternatively, time-based fees at a fixed hourly rate or flat-rate fees are agreed. The fee is generally payable upon completion of the mandate or upon a court decision on costs (see Section 8 RVG). Nevertheless, a reasonable advance payment may be required (Section 9 RVG). The mandate may be terminated at any time without giving reasons and without any formalities. Whether and to what extent fee claims nevertheless exist depends on the individual case.
Complaints may be lodged with the Munich Bar Association. Lawyers are not obliged to participate in a dispute resolution procedure. The practising lawyers at this firm do not agree to participate in such a procedure either. Nevertheless, they provide the following information:
An independent body has been established at the German Federal Bar Association to mediate disputes between members of bar associations and their clients. The body is known as the “Lawyers’ Conciliation Board”. The Conciliation Board is a consumer conciliation body under the Consumer Dispute Resolution Act of 19 February 2016 (Federal Law Gazette I, p. 254). The Conciliation Board can be contacted at the following address: Neue Grünstraße 17, 10179 Berlin, telephone +49(0)30/2844417-0, fax +49(0)30/2844417-12, email: schlichtungsstelle@s-d-r.org. Information on the conciliation procedure can be found on their website: http://www.schlichtungsstelle-der-rechtsanwaltschaft.de/.
In the event that the client relationship is classified as an online service contract within the meaning of Regulation (EU) No 524/2013, please refer to the EU Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr/
